Unemployment
An AppalReD client was facing eviction in a matter of days. He was discharged from his place of work for
excessive absences. However, he only missed one full day of work, had left early twice, and was two minutes
tardy from lunch on one occasion. The client had valid excuses for each occurrence and had written
documentation. He properly reported each of the absences and his tardiness. The client had little success in
defending himself until AppalReD appealed.
 
AppalReD representatives educated the employer on the Kentucky
Statute definition of misconduct as it applies to Unemployment Compensation at the hearing. The employer
learned that the Kentucky legislature does not intend for employers to be in control of which employees
receive unemployment benefits. Because our client could show good cause for his absences, he was not
discharged for misconduct for the purposes of unemployment benefit eligibility. The client received his
unemployment back pay and was able to pay his landlord, thereby avoiding eviction and homelessness for
himself, his girlfriend, and their 2 year old son.
